“Delictual actions are subject to a liberative prescription of two years. This prescription commences to run from the day that injury or damage is sustained. It does not run against minors or interdicts in actions involving permanent disability and brought pursuant to the Louisiana Products Liability Act or state law government product liability actions in effect at the time of the injury or damage.”

Note that the new two-year deadline does not apply to other cases commonly referred to as personal injury claims. For example, both wrongful death actions and survival actions still have a one-year statute of limitations.

Exceptions to the Louisiana Statute of Limitations in Personal Injury Claims

Some important exceptions to Louisiana’s statute of limitations include:

  • Personal action claims for minors. If a person is under the age of 18, the statute of limitations does not commence until they turn eighteen. 
  • The discovery rule. When injuries are not immediately known, or the cause of your injuries is not immediately known, the statute of limitations may be paused until the injury is discovered. 
  • When the government is a defendant. If your claims involve a government agency, you usually have a much shorter filing deadline.
