What are Damages?

You can receive financial compensation for general damages, just like for special damages, but the amount you are owed isn’t so clear-cut.

How are General Damages Calculated in Louisiana?

General damages, such as those for pain and suffering, mental anguish, and loss of enjoyment of life cannot be easily quantified. Accordingly, subjective amounts are awarded by the judge or jury, which generally consider the severity and length of the injury, the medical expenses (past and future), and the lifestyle adjustments required because of the accident.

In every claim for general damages, expert medical testimony is required in addition to specific testimony by the plaintiff.
