In Louisiana, you’re entitled to recover if you’re injured through the fault of another. You’re entitled to recover both general damages, which consist of pain and suffering, mental anguish, past, present, and future, as well as special damages, which includes past and future medical expenses as well as lost wages.
Importantly, in order to recover damages, you have to be totally in the right. What I mean by that is, in the event that you are at fault—let’s say 50%—then your recovery is reduced by 50%.
